These Terms and Conditions ("Terms") govern your use of the Dank mobile application ("App") operated by Dank Technologies Private Limited ("Company," "we," "us," or "our"). By accessing or using our App, you agree to these Terms. If you do not agree to these Terms, please do not use our App.

‍By downloading, installing, or using our App, you agree to be bound by these Terms and all applicable laws and regulations. If you do not agree with any part of these Terms, you must not access the App.

‍You must be at least 16 years old to use our App. By using the App, you represent and warrant that you meet this age requirement.

‍3. USER ACCOUNTS

‍To access certain features of the App, you may be required to create an account. You agree to:

- Maintain the security of your password and accept all risks of unauthorized access to your account.-
- Notify us immediately if you discover or suspect any security breaches related to the App.

You grant us a non-exclusive, worldwide, royalty-free license to use, modify, publicly perform, publicly display, reproduce, and distribute such User Content in connection with the App. You represent and warrant that:

- You own or have the necessary rights to use and authorize us to use all User Content.
- Your User Content does not violate any third-party rights, including intellectual property rights.

‍You agree not to:

- Use the App for any illegal or unauthorized purpose.
- Post or transmit any content that is unlawful, harmful, abusive, defamatory, obscene, or otherwise objectionable.
- Interfere with or disrupt the App or servers or networks connected to the App.

‍All content and materials on the App, including but not limited to text, graphics, logos, and software, are the property of Dank Technologies Private Limited or its licensors and are protected by applicable intellectual property laws. You may not use, reproduce, distribute, or create derivative works of such content without our prior written consent.

‍The App may contain links to third-party websites or services that are not owned or controlled by us. We are not responsible for the content, privacy policies, or practices of any third-party websites or services.

‍8. PRIVACY POLICY

‍Your use of the App is also governed by our Privacy Policy, which can be found at https://www.joindank.com/privacy-policy. By using the App, you consent to the collection, use, and sharing of information as described in our Privacy Policy.

‍9. LIMITATION OF LIABILITY

‍To the maximum extent permitted by law, Dank Technologies Private Limited shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:

- Your use or inability to use the App.
- Any unauthorized access to or use of our servers and/or any personal information stored therein.
- Any bugs, viruses, or other harmful code that may be transmitted to or through the App.

‍10. INDEMNIFICATION

‍You agree to indemnify, defend, and hold harmless Dank Technologies Private Limited and its affiliates, officers, agents, employees, and partners from any claims, liabilities, damages, losses, and expenses, including without limitation reasonable attorney's fees, arising out of or in any way connected with your access to or use of the App, your User Content, or your violation of these Terms.

‍11. TERMINATION

‍We may terminate or suspend your access to the App, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms. Upon termination, your right to use the App will immediately cease.

‍12. GOVERNING LAW

‍These Terms shall be governed and construed in accordance with the laws of India, without regard to its conflict of law provisions. You agree to submit to the personal jurisdiction of the courts located in Bengaluru, Karnataka, India, for the purpose of litigating all such claims or disputes.

‍13. CHANGES TO TERMS

‍We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. By continuing to access or use our App after those revisions become effective, you agree to be bound by the revised terms.

‍14. ACCOUNT SUSPENSION

‍If we are required by law or if you have violated our Terms or our other policies, we may suspend or permanently disable your account, terminate your access to the App and Services, deactivate or delete your account and all related information and files, or bar your access to any of such files or Services. We can take such decision at our own discretion, without your prior consultation, without liability to you and at any time. Where appropriate, you will be informed about our decision the next time you try to access your account.

‍15. MISCELLANEOUS

These Terms make up the entire agreement and understanding between you and Dank Technologies Private Limited regarding the use of our App and Services. These Terms supersede and replace all prior agreements or understandings, whether written or oral, with respect to the same subject matter.

Whenever possible, these Terms will be interpreted in such a way as to be valid, effective, and enforceable under applicable law. However, if one or more provisions (or sections) are found to be invalid, illegal, or unenforceable, in whole or in part, the remainder of that provision (or section) and of the Terms in general shall continue in full force and effect as if such invalid, illegal, or unenforceable provision (or section) had never been contained herein.

You cannot assign or transfer any of your rights or obligations under these Terms, in whole or in part, to any third party without our prior written consent. Any assignment or transfer without our consent will be deemed null and void.We reserve all rights not expressly granted to you.
